Hey Barkeep! Gimme another! (DUI, that is)

The Chicago Tribune “Breaking News” section is reporting a Illinois woman celebrated the last day of her DUI suspension by hitting the bottle… and driving home. Of course she was stopped by police… and reportedly blew a 0.155% BAC (well over the legal limit of 0.08% BAC).

She had been arrested in 2012 and lost her license. She was scheduled to regain her driving privileges the next day. Erin James will now learn the hard way that you never count your chickens until they’ve hatched. This time things will be a bit more complicated, because according to the police report, James was required to drive a car equipped with an ignition interlock device that would prevent drunk driving. The Police Chief suggests that her action of driving a non-breath alcohol ignition interlock device (BAIID) equipped car demonstrated a specific intent to drive drunk. If the judge believes that, Erin James may be in for a very difficult “second DUI”.

"Erin James’ driver’s license had been suspended in 2012 after a DUI arrest in North Riverside. She told a Riverside Police officer she had been out celebrating the fact that she would be getting her license back from that 2012 DUI arrest."
